Terms of Service

Last updated: February 2026

Welcome to NyxNet. By accessing or using NyxNet, you agree to be bound by these Terms of Service. Please read them carefully before using our service.

Overview of Services

NyxNet provides a privacy-focused, end-to-end encrypted instant messaging platform built on open protocols. Our services include text messaging, media sharing, group conversations, and voice/video calls β€” all protected by client-side encryption. NyxNet is designed to give you full control over your communications.

Account Registration & Security

To use NyxNet, you must create an account using a supported wallet address or social login via Particle Network. You are responsible for maintaining the security of your account credentials, private keys, and any devices used to access NyxNet. You must not share your account with others or allow unauthorized access. NyxNet cannot recover your private keys or encrypted messages if lost.

User Conduct

You agree not to use NyxNet to: transmit illegal content or facilitate illegal activities; harass, threaten, or abuse other users; distribute malware, spam, or phishing attempts; attempt to circumvent security measures or exploit vulnerabilities; impersonate other individuals or entities; or use automated systems to send bulk messages. Violation of these rules may result in account suspension or termination.

Content & Intellectual Property

You retain ownership of all content you send through NyxNet. Since messages are end-to-end encrypted, NyxNet cannot access or claim rights to your message content. The NyxNet application, brand, logos, and underlying technology are the intellectual property of NyxNet and are protected by applicable laws. The open-source components of NyxNet are available under their respective licenses.

Privacy & Data Protection

Your privacy is fundamental to NyxNet. We collect minimal data and encrypt all message content client-side. For full details on how we handle your data, please refer to our Privacy Policy. By using NyxNet, you also agree to the data practices described in our Privacy Policy.

Service Changes & Termination

NyxNet reserves the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will make reasonable efforts to notify users of significant changes through the app. You may delete your account at any time, which will permanently remove your data from our servers within 30 days. We may terminate or suspend accounts that violate these terms.

Disclaimers

NyxNet is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure against all threats. While we implement industry-leading encryption, no system is 100% infallible. You use NyxNet at your own risk.

Limitation of Liability

To the maximum extent permitted by law, NyxNet and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the service. Our total liability shall not exceed the amount you have paid to NyxNet in the twelve months preceding the claim.

Dispute Resolution

Any disputes arising from these terms or your use of NyxNet shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable rules, except where prohibited by law. You agree to resolve disputes on an individual basis and waive any right to participate in class actions.
